By accessing or using our website, services, and products—including apparel, drinkware, promotional items, paper products, and custom merchandise—you agree to these Terms & Conditions. Please read them carefully, as they establish a legal agreement between you (the “Customer”) and us (“Every Spartan™,” “we,” “our,” or “us”).

1. Eligibility

To place an order or use our services, you must:

• Be at least 18 years old, or have parental/guardian consent.
• Provide accurate, current, and complete information when making a purchase.

2. Orders & Payments

Order Acceptance:
All orders are subject to review and acceptance by TURTLEFOX LLC. We reserve the right to refuse or cancel any order at our discretion.

Payment:
Payment must be made in full before production or shipment of products. Accepted payment methods will be listed at checkout.

Pricing:
Prices are displayed in USD and may change without notice. Applicable taxes, shipping, and handling fees will be added at checkout.

3. Custom Artwork & Designs

By submitting artwork, logos, or designs, you confirm that you own the rights to use that content or have obtained proper authorization.

You grant TURTLEFOX LLC a limited license to use, reproduce, and modify your submitted content solely for the purpose of fulfilling your order.

We are not responsible for errors in customer-provided artwork, including but not limited to typographical errors, low-resolution files, or incorrect color selections.

4. Production & Delivery

Production Times:
All products are made-to-order. Standard production timelines vary by product type and customization. Estimated timelines will be communicated at checkout or in your order confirmation.

Shipping:
Delivery times may vary depending on location and carrier. TURTLEFOX LLC is not responsible for delays caused by shipping carriers, weather conditions, or other factors outside our control.

Risk of Loss:
Ownership of products transfers to you upon delivery to the carrier.

5. Delays & Unforeseen Circumstances

Every Spartan™ is committed to fulfilling orders in a timely and reliable manner. However, as a small, independently operated business, there may be rare instances where fulfillment timelines are impacted by circumstances outside of our control.

These may include, but are not limited to, production delays, supply chain disruptions, or unforeseen personal or medical circumstances that temporarily affect operations.

In the event of a significant delay, we will communicate transparently with customers and provide updates as they become available. Where appropriate, customers will have the option to continue waiting, modify their order, or request a refund.

6. Returns, Exchanges & Cancellations

Custom Products:
Due to the personalized nature of our products, all custom orders are final and non-refundable unless the product is defective or damaged upon arrival.

Defective Items:
If you receive a defective or incorrect item, please notify us within 3 days of delivery to be eligible for a replacement or store credit.

Cancellations:
Orders may only be canceled before production begins. Once production has started, cancellations are not possible.

7. Intellectual Property

All designs, logos, images, product descriptions, and website content created by TURTLEFOX LLC are the intellectual property of the company and may not be copied, reproduced, modified, or distributed without prior written consent.

Customers retain ownership of their submitted artwork but grant TURTLEFOX LLC rights for fulfillment as described in Section 3.

8. Website Use

By using our website, you agree not to:

• Engage in unlawful or fraudulent activity
• Attempt to gain unauthorized access to our systems or data
• Use our site or services to infringe on the rights of others

9. Limitation of Liability

To the maximum extent permitted by law, TURTLEFOX LLC shall not be liable for:

• Indirect, incidental, or consequential damages
• Losses resulting from delays, defects, or unauthorized use of your information
• Errors resulting from customer-provided information or artwork

Our total liability, if any, shall not exceed the total amount paid for the order in question.

10. Indemnification

You agree to indemnify and hold harmless TURTLEFOX LLC, its employees, and affiliates from any claims, damages, or expenses arising from your use of our products, services, or submitted content.

11. Governing Law

These Terms & Conditions shall be governed by the laws of the State of Michigan, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts located in Michigan.

12. Changes to Terms

We may update or modify these Terms & Conditions at any time. Changes will take effect upon posting to this page, with the “Last Updated” date revised accordingly. Continued use of our site or services after updates constitutes acceptance of the revised terms.
